Digging Into The Clearinghouse Return To Duty Process- 28 Oct

The FMCSA Drug and Alcohol Clearinghouse keeps records on all testing program violations by any drivers holding a CDL or Commercial Learner’s Permit (CLP). Ideally, you won’t run into an encounter with this group, but if violations do occur, what can you do to get clearance to return to duty? Let’s take a look at the process to return to duty (RTD). The driver, the substance abuse professional (SAP), and the employer all have a part in the RTD process. Once the violation occurs, the driver must complete this process if intending to drive a commercial vehicle again.

Once the violation has occurred: 

  • The employer will give the driver a list of SAPs to choose from. The driver then gets an SAP, which requires them to log into the Clearinghouse and send that SAP a designation request.
  • Once the SAP accepts, they will set up the initial assessment test and determine the date the driver will be eligible to take the RTD testing.
  • At this point, the employer directs the driver to take the RTD test. The driver needs an employer who is willing to sponsor their progress through the RTD process and testing.
  • The employer has to record the rest of the process for RTD negative tests and any follow-up testing plan.

Moving forward after a violation has occurred is a difficult path. However, using this information and focusing on the return to duty process will help put your career back on the right track.
